Manifest Tax Error or Legal Interpretation? Plenary Session E. 2025/16

14/11/2025

Council of State, Plenary Session of the Tax Chambers, E. 2025/16 (resolution of conflicting decisions)

The age-old debate in tax law between “manifest tax error” (Article 118 of the Tax Procedure Law) and “legal interpretation” (Article 3) can cause taxpayers losses of hundreds of thousands of liras. The subject was the special consumption tax on range-extender electric vehicles; should these vehicles fall under the 80 percent rate or under the 10 percent “electric motor only” status? The regional administrative courts were divided on the question.

The Plenary Session resolved the conflict. Since the matter requires the examination of technical documents and the special consumption tax list, it is not a manifest tax error but a dispute requiring legal interpretation.

The most important consequence of the decision is that, for taxpayers who missed the thirty-day period for suing, the possibility of obtaining a refund through the correction and complaint route has effectively come to an end in disputes of this kind. By keeping the field of legal interpretation wide, the Plenary Session seriously narrowed the institution of tax error in Article 118. The importance of suing within thirty days was confirmed once more as an absolute necessity. Whether these decisions of the Plenary Session under Article 3/C of Law No. 2576 are binding is a debate in its own right.
